WORK’S CHEMIST LENT FIRM’S VAN SUMMONS RAISES INTERESTING POINT. An interesting question of law was raised when a work’s chemist, using a van with the permission of his firm for personal reasons, was summoned for failing to keep the prescribed records when driving it on Nov. 28, 1937. Defendant William Pollard, of Prestwich, was represented by Mr Wm. Hamnett, solicitor (Bell, Hough and Hamnett), who contended that Pollard was not a driver within the meaning of the Act. Constable F. Knighton said at 7-35 p.m. he was on duty in Buxton-road when he pulled up the defendant, who was driving a van, and asked him to produce his log book. He replied “I have not got it with me.” Ernest Pugh, an examiner appointed by the Ministry of Transport, said the case was reported to his department. This was a “C” carrier’s license, and one of the conditions was that the driver should keep records. When the case was reported the Department wrote to the firm, who replied in letter stating that the van had been used for personal and private reasons and had been lent to the defendant by the firm. Replying to Mr Hamnett, witness agreed that though the firm had explained that the vehicle had been used for private purposes, that it was not carrying goods, and was not being used by an authorised driver, they had insisted on a summons being issued. Mr. Hamnett submitted that this case was not covered the Act. These regulations were brought into law in consequence of the trouble experienced through drivers who, having been at the wheel far too long, fell asleep, or became over-fatigued, thereby causing accidents. It was a very wise measure. He contended, however, that a man using a vehicle without load for purely personal reasons was not a driver within the meaning of the Act. Under the section it stated “in respect of every person employed by him as a driver.” Defendant was employed as work’s chemist and had never been a driver for the firm, which employed authorised drivers. Referring to the fact that there was no load on at the time, Mr. Hamnett said it was questionable whether an authorised driver was compelled to keep records when the van was empty. Mr. Hamnett also submitted that defendant had not been on a “journey” within the meaning the Act. After retiring the Chairman said the Clerk (Mr. H. Newton) had asked for a week to consider the legal aspect of the question, and the case was adjourned accordingly |

NOT “WITHIN THE MEANING OF THE ACT.” A case against William Pollard of Chatsworth Avenue, Prestwich, who was summoned for failing to keep prescribed records when driving a goods vehicle on November 28, was dismissed the magistrates. The case came for hearing on Saturday last, and Mr. Hamnett (Messrs. Bell, Hough and Hamnett), explained that the defendant had used the van with the permission of his firm for purely personal reasons. There was no load and he was not employed by the firm as a driver, but was the works chemist. In Mr Hamnett’s submission the section of the Act designed to prevent accidents caused through a driver being over-fatigued applied to authorised drivers, and defendant was not a driver within the meaning of the Act. When the magistrates had announced their decision Mr Hamnett said he considered an advocate’s fee and witnesses fees should be given. The Chief Constable (Mr G. W. Robotham) opposed the application, but after a retirement the magistrates said they were of the opinion that it was proper case for a solicitor to appear for the defence and they allowed an advocate’s fee of £2 2s 0d . |
