SEQUEL TO A BIGAMOUS MARRIAGE. Mr. Garrett gave his decision at the West London Police Court on Monday, on an application for the discharge of a maintenance order obtained in October, 1907, against William Jeutter, a metal chaser, of 28, Campbell Street, Paddington, by his wife, Emily Jeutter, of 39a, Goldhawk Road, Shepherd's Bush. Mr. H. Pierron appeared for the applicant, and the application was resisted on behalf of Mrs Jeutter by Mr. Leslie Smith. At the last hearing Jeutter voluntarily went into the witness box and admitted that he was not legally married to the defendant, inasmuch as at the time he went through the form of marriage with her, in 1904, his lawful wife, whom he married at Islington in 1894, was still alive. He added that, before contracting the second marriage, he made inquiries to discover whether or not his wife were alive, and, learning nothing, concluded she was dead. He explained that they had only lived together for three years, when she left him, and he heard nothing of her since until a couple of months ago. At this hearing evidence was given by Walter Bourne, of The Cottage, Norton, Letchworth, who stated that he was brother to Jeutter's first wife, who was still alive, and had lived with him (witness) for the past 12 years. In answer to Mr. Leslie Smith, the witness said that Jeutter was perfectly well acquainted with her whereabouts. Mr. Pierron: I object to that question. The Magistrate: Well, the point is not material to this inquiry. Mr. Pierron submitted that on this evidence the application should be granted, and Mr. Garrett agreed and discharged the maintenance order. There was a summons against Jeutter for the payment of £30 as arrears under the order. Mr. Pierron argued that, as the marriage was illegal, the order was void ab intro, and therefore the defendant could not be called upon to make any payments under it. Mr. Leslie Smith submitted that the order ran so long as it was not set aside. Mr. Garrett observed that the point was an important one, and had never yet been taken to the High Court, though it had been raised. In this case all the hardships were, of course, on one side, and he should make an order for the payment of arrears, leaving it to the defendant to appeal. His worship added that his view was that the order was valid until it was set aside. |
