IMPORTANT TO WATERMEN.On Wednesday last, William Henry Wardell, a waterman, of this town, was summoned before Mr. Secker, at the police-court, to answer an alleged infringement of the Watermen's Act by carrying passengers in his boat on Sunday to view the Leviathan. The information was laid by Mr. Ellis Smith, who claimed the right, as ferryman, to such trade. In the absence of Mr. Smith, the section under which the proceedings were taken was pointed out by another person, and Mr. Seeker reading it, and hearing from the defendant that the persons he had taken in his boat were a pleasure party, and that after thanking them around the Leviathan he landed them at the place he took them from, his worship ruled that no offence had been committed, the Sunday ferry rights only securing the privilege to the complainant of carrying persons to any ship or across the river between certain points. It could not be said that the party had gone on board the Leviathan, and therefore the summons would be dismissed. The defendant asked for his expenses, for the payment of which and the attendance of Mr. Smith the summons was adjourned until yesterday (Friday), when the complainant was ordered by Mr. Traill to pay defendant's expenses, amounting to 12s. |
