LIABILITY OF MASTERS FOR THE MISCONDUCT OF THEIR SERVANTS.—At the Croydon petty sessions on Monday, Mr. George Hall, the proprietor of extensive lime-works at Merstham, attended before the bench to produce one of his carmen, to answer a charge preferred by Mr. Adams, a magistrate of this bench, for riding on his waggon. It appeared from Mr. Adams's statement that as he was riding to town he met one of Mr. Hall's waggons, and the carman was riding in it, and when Mr. Adams requested him to get out and take care of his horse he refused to do so and laughed at him. Mr. Adams, however, could not identify the man. Mr. Hall now produced a man who, he said, was with the waggon on the day in question. The man, however, declared positively that he had not acted in the way described, and that he knew nothing about the matter. Mr. Adams said he could not recognize this man as the person who had committed the offence, but that did not matter, as if Mr. Hall did not produce the offender he would be liable to the fine himself. Mr. Hall said he did not understand how he could possibly be subjected to a fine for an offence committed by one of his men. He was ready to bring forward the person who had offended if he could discover him. The Bench said there was no doubt that in law he was liable, and, therefore, as he had not produced the individual who had committed the offence, they should fine him 10s. and costs. Mr. Hall exclaimed against the hardship of the proceeding, but the Bench said the public must be protected from such proceedings on the part of the carman, and fine would in every case of the kind be inflicted.

Mr. George Hall, of Merstham, attended before the magistrates to answer a summons obtained against him by one of his men, for not paying him his wages, but upon a full investigation the magistrates decided that the man had no claims upon Mr. Hall, and they therefore dismissed the summons, and ordered the complainant to pay the costs.
