1833-03-22 made will:

This is the last will and testament of me William Sutton of the town and county of Newcastle upon Tyne Grocer and Tea Dealer /that is to say/ I order and direct that all my just debts funeral and testamentary expences and the expences of proving this my will shall be paid off and discharged by my Executors hereinafter named as soon after my decease as conveniently may be and subject thereto I give and bequeath all my household goods furniture plate china wines and liquors unto my dear wife Mary Sutton absolutely — I also give and devise unto my said dear wife and to her heirs and assigns all that my field or parcel of land situate at Stanwix in the county of Cumberland and which I received as part of her marriage portion and I further give and bequeath unto my said dear wife the sum of one thousand Pounds of lawful British money to be paid to her by my Executors hereinafter named as soon after my decease as conveniently may be and subject thereto I give devise and bequeath unto my father in law Elihu Sutton of Scotby in the county of Cumberland Farmer and my friend William Holmes of Newcastle aforesaid Grocer their heirs executors administrators and assigns All that freehold shop messuage and premises which I now occupy situate in Mosley Street in Newcastle aforesaid And all that sum of Four hundred Pounds which was given to me by the will of my late Grandmother Margaret Sutton and payable to me on the death of Ann Wardman wife of Thomas Wardman of Gateshead Glue Manufacturer And all that sum of Eight hundred and fifty Pounds the produce of the sale of the messuage and property formerly belonging to my Father Thomas Sutton situate at Jesmond Place in the county of Northumberland and payable to me on the decease of my dear Mother Mary Sutton And all that sum of Eight hundred and fifty Pounds for which my life is insured with the Society of the Yorkshire Life Insurance office And all my stock in trade book debts and all other my real and personal estate and effects of what nature or kind soever which I shall die possessed or interested in Upon the Trusts following /that is to say/ Upon Trust to pay thereout such sums of money as to them my said Trustees shall seem proper for the maintenance and education of such child or children as I shall leave at the time of my decease or as shall be born within due time afterwards and when and as my said children shall attain their respective ages of twenty one years or at such other time as they my said trustees shall in their discretion think fit then upon trust to divide the same and all profits and interest due in respect thereof equally between and amongst my said children share and share alike And my will is that if any of my said children shall die before his or her said age then that the share of him so dying shall go unto and be equally divided amongst my surviving children if more than one and if there shall be but one surviving child then that the whole shall belong to such surviving child his or her heirs executors administrators and assigns for ever And in case none of my said children shall attain his or her said age then Upon Trust to pay thereout the further sum of of One thousand Pounds to my said dear wife Mary Sutton if she shall then continue my widow absolutely for her own use and to be at her disposal and Upon Trust to divide the rest and residue of my said estate and effects equally between and amongst such of the children of my uncle Jonathan Drewry of Whitehaven in the county of Cumberland as shall be living at the time of my decease and to their heirs and assigns absolutely for ever And I hereby empower my said trustees at their discretion to cease or continue to carry on my said trade or business and to sell all or any part of my estate and effects as aforesaid and to place out or invest the proceeds therefor any part thereof upon government or real securities at interest and to alter vary and transfer the same and generally to act in the premises as to them or the survivor of them shall seem fit And thereby direct that the receipts of my said trustees or the survivor of them shall be good and sufficient discharges for any money paid to them under the trusts aforesaid and that they shall not be answerable or accountable for any loss or damage costs or expences which may be incurred in the execution of the said trusts unless the same shall happen thro their or his own wilful default or negligence And I hereby appoint the said Elihu Sutton and William Holmes Executors of this my will and Trustees of my said Children And hereby revoking all former and other wills by me at any time heretofore made I do declare this only to be and contain my last will and testament In witness whereof I have hereunto set my hand and seal this twenty second day of March One thousand eight hundred and thirty three.

TO MR. WILLIAM SUTTON,

WHOLESALE TEA DEALER.

SIR,—if your real Object in addressing me was to ascertain whether the Teas advertised by me were direct from China? and whether they had ever been offered for sale at any previous Time? you would, I think, have made the Enquiry in a different manner, and through a different Channel.

But whatever be your motive in putting such Questions to me through the public Press, I am glad to have an opportunity of informing you and others, that the Teas ex "MID-LOTHIAN," advertised by me for Sale at Newcastle on the 12th inst., is a Direct Importation from Canton, and have never, directly or indirectly, at any Time, been offered for Sale either publicly or privately, nor up to this day have they ever been shown.

You know, or at least ought to know, that the Transhipment was solely owing to the Non-Adaptation of Warehouses at this Port for the Reception of the Teas in the original Bottom; a defect which, in the present instance, has been attended with great inconvenience and much additional expense, but it is to be hoped the Chamber of Commerce, and those interested in the welfare of this Town, will now endeavour to obviate and relieve Newcastle as a Dependency on London or any other Port.

At his residence, Jesmond, on the 5th inst. W. Sutton, grocer, of Mosley-street, after a few days' illness, aged 38. He was a member of the Society of Friends, and an ornament to the age in which he lived, possessing all those amiable qualifications that adorn mankind.
